Frequently asked questions

Do I need Advance Assurance?

If you're in the early stages or actively seeking investors, Advance Assurance can significantly strengthen your pitch. Many S/EIS investors require HMRC’s Advance Assurance before committing funds, as it confirms eligibility for tax relief. However, if your investors are willing to invest without the need for tax incentives, then applying for Advance Assurance may not be necessary.

How long does Advance Assurance take?

HMRC typically aims to respond within 15 business days. However, the process can take longer, especially as the end of the tax year approaches when HMRC experiences higher demand. Delays may also occur if HMRC requests additional information or clarification.

What do I need to send to HMRC?

At a minimum, you’ll need to provide:

  • Your Business Plan or Pitch Deck
  • 24-month financial projections

As your company grows or becomes more complex, HMRC may require additional documents to assess your eligibility.

What are the excluded activities?

HMRC has a detailed list of excluded activities, but the most common ones include:

  • Legal services
  • Financial services
  • Leasing or renting
  • Energy production
  • Property development
  • Agriculture

We incorporated over three years ago, can we still qualify?

Yes! You can still qualify, depending on your trading history:

  • SEIS: You must demonstrate that your company has not been trading for more than three years.
  • EIS: Your company must be within seven years of its first commercial sale.
